Basics
Does the insurer have any responsibility for the loan?
No. IFS-PF point 2 states that the insurer is not a party to the loan contract or the policy assignment agreement and is not governed by their terms, including dispute resolution. The insurer's responsibilities are the policy itself and compliance with the IA's standards in selling and underwriting.
How common is it in Hong Kong?
The IA circular of 20 August 2026 says use of premium financing increased markedly in the first half of 2026, has become the main source of new business for some insurers, and exceeds 80% of policy count or premiums for some individual products. A press report (The Standard, 20 August 2026) put the share at about 36% of new business premiums in the first half of 2026; that figure is not in the circular itself.
Loan ratio and rates
How is the interest rate set?
Benchmark plus margin. HSBC's Key Facts Statement of 16 October 2026 shows HKD floating loans at 1-month HIBOR plus 0.75% to 2% (floor 0.75%), HKD fixed rates of 4.3% for three or five years (indicative only), and USD loans at the USD best lending rate minus 1.5% (floor 0.75%). 1-month HIBOR was 2.68% on 3 November 2026 (HKAB). Rates change with the market and bank policy.
Can the bank change the way the rate is calculated during the loan?
Possibly, but only if disclosed. The HKMA circular of 16 October 2023 found that some banks had relied on embedded clauses to change the rate basis without customers' clear awareness, and now requires every building block (HIBOR-based, Prime-based and the bank's cost of funds) to be explained at application and set out with equal prominence in the same part of the facility letter.
Standards and documents
What rules apply, and since when?
The IA circular of 1 April 2022 applies to every new life application funded by premium financing received on or after 1 January 2023: three affordability tests, over-leveraging screening, asset and income verification, and the IFS-PF. The HKMA circular of the same date covers banks as intermediaries and as lenders, including fair handling of cooling-off cancellations and disclosure of the loan-to-own-resources ratio.
What is the IFS-PF and when is it signed?
The Important Facts Statement – Premium Financing is the annex to the IA circular. It lists fifteen notes and implications and two declarations: whether the intermediary solicited the use of financing, and whether the customer is willing to disclose the lender, loan amount, rate, tenor and instalment. It must be explained as soon as financing is raised and signed and dated by the customer before policy issuance.
Affordability and over-leveraging
What are the three affordability tests?
Whether the customer has sufficient financial resources to pay the unfinanced portion of the premium at the outset, to meet all scheduled principal and interest repayments over the whole tenor, and to repay the facility if the lender demands it before policy maturity. Where the tenor is not fixed, the intermediary should assume the facility lasts for the entire policy term.
What does over-leveraging mean?
The IA defines it as the situation where a lender's repayment demand before policy maturity cannot be fully met from the customer's own funds and can only be met from the surrender value of the proposed policy. Where the risk exists, the intermediary should not recommend the policy without justification and the insurer should take a prudent approach, including rejection.
Does my home count as proof of assets?
Generally not. The IA circular requires insurers, when verifying asset proof, to adjust jointly owned assets to the customer's share, net off liabilities, and normally not accept owner-occupied property. Bank credit assessment has its own criteria, but the HKMA requires banks to consider and disclose the ratio of loan amount to the customer's own financial resources where over-leveraging risk exists.
Risk and exit
What happens if rates rise by two percentage points?
On an illustrative USD680,000 loan, a rise from 4.5% to 6.5% raises annual interest from USD30,600 to USD44,200, or USD136,000 more over ten years. On illustrated values, the ten-year annualised return on USD320,000 of own funds falls from about 3.8% to about 0.2%; a four-point rise turns it to about minus 5%. These are hypothetical figures used to show the mechanics.
Is there still a cooling-off period?
Yes, 21 calendar days under GL29, but the right to cancel may have been assigned to the lender, so cancellation may need its consent, and the borrower must still repay principal, interest, administrative fees and any early repayment charge (IFS-PF point 15). The HKMA requires banks not to obstruct the right with fees and to refund the net amount promptly.
What do beneficiaries receive on death?
The death benefit less the outstanding loan, interest and charges. IFS-PF point 9 warns that the death benefit may be substantially less than premiums, interest and charges paid; the lender, as assignee, is paid first. Changing beneficiaries during the loan requires the lender's approval (point 3).
Mainland residents
Can a Mainland resident sign the policy and loan documents in the Mainland?
No. Hong Kong policies must be signed in person in Hong Kong, and applicants holding a PRC resident identity card must sign the Important Facts Statement for Mainland Policyholders (IFS-MP, in force since 1 September 2016). Policies solicited or signed in the Mainland are outside Hong Kong regulatory protection; the IA circular of 12 June 2024 targets business models that incentivise unlicensed selling to Mainland visitors. Cross-border funding of the premium, interest and principal is subject to Mainland rules on which readers should obtain their own advice. This site carries on no sales activity in Mainland China.
